Trust and Estate

Wills

A will is like a “letter” directing your executor to distribute assets to certain people. Wills can come in different forms; they can be statutory, handwritten, or drafted by an attorney. A pour-over will is a type of will that transfers assets remaining in your estate at the time of death into a special trust. Please be advised that each type of will is subject to particular statutory rules and limitations. Contact an attorney before taking on any type of will.

Trusts

In the simplest terms, a trust is a fiduciary relationship between the creator of the trust and a trustee, a person that holds property or assets for a beneficiary. This entity holds property in charge of a fiduciary with particular rights and powers. A common and effective type of trust is a living trust. This type of trust allows the owner to retain powers and control over the assets assigned to it, but with the benefit of avoiding Probate at the time of death.
